All developed countries use Labour laws to regulate their social goals. Therefore, among the differences that can be found within a country’s legal system, there are some common themes that they share in their aspiration to regulate their social goals. Through the lens of comparative law, we will take a close look at labor-related matters while keeping Otto Kahn Freund’s words in mind: ‘Legal institutions are not exportable – not even between common-law countries-but, thank God, legal ideas are not patentable either. We cannot copy your institutions and you cannot copy ours, but we can learn from each other.’ (Trade Union Democracy and the Law, A.B.A. Section of Labor Relation Law Proc 24, 37 (1960)). Hence, we will attempt to explain the main legal paradigms and solutions that Italy and Israel developed to deal with similar workplace issues.
